This week, we submitted a comment in response to proposed changes to regulations based on Title IX of the Civil Rights Act posted by the U.S. Department of Education this past July. Title IX of the Civil Rights Act prohibits federally-funded educational institutions from discriminating “on the basis of sex”:
No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance….
The Department’s proposed changes add self-determined “gender identity” as a protected trait for purposes of both sex discrimination and sex-based harassment; require schools and universities with sex-segregated facilities and activities to allow individuals to access activities and spaces that align with their gender identity, as opposed to their biological sex; and obligate school and university employees to report conduct that “may” constitute sex discrimination, with no requirement of a reasonable belief that the conduct rises to the level of prohibited sex discrimination.

In Green v Secretary of State for Justice [2013] EWHC 3491 (Admin), the claimant sought judicial review of the prison authorities’ refusal to supply him with items he said were necessary to enable him to “live as a woman”. He said that he was transgender, and the prison was acting in breach of the applicable policy, and discriminating against him on grounds of his gender reassignment.
The High Court dismissed the application, finding that, since Green was male, and no other male prisoner would have been supplied with the items he sought, he was not treated less favourably than a hypothetical comparator without the protected characteristic of gender reassignment. … read full article

So, back in May, when I announced I was working on a book called The New Puritans, I wasn’t all that surprised to see so many self-proclaimed advocates of ‘social justice’ rush to demonstrate the very phenomenon that I was attempting to explore. Some suggested that they would acquire copies only to burn them. One said that he intended to kick it under the bookshop shelf ‘so that it could rot in darkness’.
